During the past decade, a small but rapidly growing number of Law&Tech scholars have been applying algorithmic methods in their legal research. This Article does it too, for the sake of saving disclosure regulation failure: a normative strategy that has long been considered dead by legal scholars, but conspicuously abused by rule-makers. Existing proposals to revive disclosure duties, however, either focus on the industry policies (e.g. seeking to reduce consumers’ costs of reading) or on rulemaking (e.g. by simplifying linguistic intricacies). (...) But failure may well depend on both. Therefore, this Article develops a `comprehensive approach', suggesting to use computational tools to cope with linguistic and behavioral failures at both the enactment and implementation phases of disclosure duties, thus filling a void in the Law & Tech scholarship. Specifically, it outlines how algorithmic tools can be used in a holistic manner to address the many failures of disclosures from the rulemaking in parliament to consumer screens. It suggests a multi-layered design where lawmakers deploy three tools in order to produce optimal disclosure rules: machine learning, natural language processing, and behavioral experimentation through regulatory sandboxes. To clarify how and why these tasks should be performed, disclosures in the contexts of online contract terms and privacy online are taken as examples. Because algorithmic rulemaking is frequently met with well-justified skepticism, problems of its compatibility with legitimacy, efficacy and proportionality are also discussed. (shrink)

Bertrand’s paradox ) can be considered as a cautionary memento, to practitioners and students of probability calculus alike, of the possible ambiguous meaning of the term ‘at random’ when the sample space of events is continuous. It deals with the existence of different possible answers to the following question: what is the probability that a chord, drawn at random in a circle of radius R, is longer than the side of an inscribed equilateral triangle? Physics can help to remove the (...) ambiguity by identifying an actual experiment, whose outcome is obviously unique and prescribes the physical variables to which the term ‘random’ can be correctly applied. In this paper, after briefly describing Bertrand’s paradox, we associate it with an experiment, which is basically a variation of the famous Buffon’s needle experiment for estimating the value of π. Its outcome is compared with the analytic predictions of probability calculus, that is with the probability distribution of variables whose uniform distribution can be considered a sound implementation of complete randomness. A comparison between the standard adiabatic piston dynamics and that of a perfectly conducting (diathermal) piston helps to clarify their different behaviors and, in particular, the anomalously large random displacement of the adiabatic piston as compared to the diathermal one. It is shown to be associated with a situation where the presence of a single massive “particle” (the piston), acting as an internal constraint in a many-particle system, plays a somewhat unexpected relevant role. A significant physical insight accounting for the (...) above difference is gained by means of a simple analysis of the phase space available to our system. (shrink)

This review discussed the effects of the impact of the Coronavirus Disease 2019 pandemic on the psychological wellbeing of people with Parkinson's disease focusing specifically on depressive symptoms, anxiety levels, sleep, and quality of life. Together with motor symptoms, psychological symptoms are common and disabling conditions in the clinical course of PD becoming a relevant topic as a result of the lockdown measure due to alter their everyday life. We searched on PubMed online electronic databases for English articles published between (...) January 2020 and 31 December 2021. Twenty-eight relevant studies were found and included in the review. Heterogeneous data emerged from the topics analyzed. Overall, data from depression studies showed significant depressive symptoms if the patient was analyzed longitudinally or vs. a control group consisting in healthy subjects, while these differences become minimal when the control group is a family member. Differently, in most of the studies reviewed there is no evidence of a statistically significant impact on anxiety disorders, nor on the quality of sleep. Conversely, PD patients showed a statistically significant negative impact of QoL compared with control groups or other neurological conditions. Although these findings must be interpreted carefully in the light of the studies' limitations, both in methodology and design, collectively our review showed that COVID-19 pandemic has had negative effects on the mental health of people with PD, due to disruption of healthcare services, loss of usual activities and supports and reduction in physical activity. Il contributo mira a presentare metodi e risultati del progetto di restauro virtuale di un settore dell’antica Porto Torres/Turris Libisonis (Terme centrali, via adiacente e botteghe prospicienti - cd. palazzo del Re Barbaro), frutto di un accordo di collaborazione tra la Direzione Regionale Musei Sardegna e l’Università degli Studi di Padova. Il metodo applicato si basa su tecnologie di fruizione in Realtà Virtuale e ha permesso il restauro virtuale, geolocalizzando il modello virtuale 3D on-site: una App comanda la visualizzazione (...) di immagini equirettangolari all’interno di visori VR, permettendo visite guidate “aumentate”. Il lavoro è partito da una raccolta bibliografica ragionata, alla quale è seguita una campagna di rilievo fotogrammetrico da drone (G. Alvito, Teravista); infine, intrecciando i dati raccolti, si è proceduto alla ricostruzione 3D virtuale degli edifici. Le evidenze strutturali oggi conservate sono state integrate nella scena 3D con puntuali confronti coevi (III sec. d.C.), virtualmente ricostruiti e ricollocati in contesti d’uso verosimili, accrescendo così l’affidabilità ricostruttiva. L’intera attività ricostruttiva è stata vincolata a un rigoroso processo di validazione scientifica basato sul metodo dell’Extended matrix e l’esito finale è ora fruibile sia mediante proiezioni tradizionali (off-site, tourismA 2020), sia mediante l’utilizzo di dispositivi mobili VR (on-site, Giornate europee del patrimonio 2020). In queste e altre occasioni si è riscontrata una eccellente risposta del pubblico, agevolato dal virtuale nella percezione e nella comprensione delle evidenze e delle volumetrie antiche. (shrink)

L'idea di relazionare la dimensionalità dello spazio ad una legge fisica, contenuta nel primo scritto di Kant "Pensieri sulla veridica estima delle forze vive", svela un modo di guardare i rapporti tra Fisica e Matematica così nuovo ed originale che potè essere sviluppato e compreso nella sua plenitudine soltanto nel secolo XX. Ci riferiamo qui ala prospettiva aperta da Ehrenfest nel suo "In what way does it become manifest in the fundamental laws of physics that space has three dimensions?". In (...) questo saggio si cerca di comprendere alcune delle radici fisiche, filosofiche e teologiche dell’approccio di Kant a questo problema, e la sua inserzione nel dibattito delle idee che sostengono la concezione meccanicista del Mondo. In primo luogo, si sottolinea che da una lettura attenta del suo Gedanken von der wahren Schätzung der lebendigen Kräfte si può concludere che - al contrario di quanto viene normalmente creduto - Kant non riuscì a dimostrare la sua congettura che la tridimensionalità dello spazio possa essere fondata sulla legge di gravitazione di Newton, secondo la quale la forza tra due corpi va come l'inverso del quadrato della distanza che li separa; in realtà, egli si limitò a giustificare la tridimensionalità della estensione. Dopo aver considerato la distinzione fra estensione e spazio, si fa notare che la catena logica della congettura del giovane Kant, presuppone la forza come concetto basilare, intrinseco alle sostanze. È mediante questa forza che si stabiliscono le relazioni tra le sostanze, le quali, a sua volta, creano l'ordine su cui viene basato il concetto di spazio. Si deve badare che la coerenza del suo argomento richiede, in ultima analisi, concepire la percezione, cioè, l'interazione fra le sostanze e l'anima, come risultato della medesima forza di lunga portata. Inoltre, si dimostra che l'argomento di Kant non poteva essere costrutto su una intelaiatura puramente newtoniana nel 1747. Infatti, egli costruì sua dimostrazione a partire da una concezione del mondo basata sul legato di Cartesio (soprattutto l'idea di um ordine cosmico) e Leibniz (l'esistenza di una forza che precede l'estensione e l'idea di spazio relativo) alla quale sovrappone, in modo ibrido, la legge di gravitazione di Newton. Si argomenta che questa scelta fu fortemente influenzata da alcune idee teologiche del Giovane Kant che divergono da quelle di Cartesio, Newton e Leibniz. Fu questo carattere ibrido del suo approccio che permise a Kant di trattare la questione della dimensionalità dello spazio come un problema di fisica, ma, che, allo stesso tempo, a causa delle sue limitazioni intrinsiche, portò Kant a provare appena la tridimensionalità della estensione. Il pensiero prospettivistico del Nietzsche maturo sorge come reazione alla «fede in un valore metafisico e in sé della verità» che, a partire da Platone, ha animato la cultura occidentale. Agli occhi di Nietzsche, tale fede si trova all’origine del processo di degenerazione antropologica che ha caratterizzato la morale europea, ed è pertanto su di essa che occorre operare criticamente se si vuole avviare un contromovimento in grado di permettere all’umanità di orientarsi nei meandri labirintici del nichilismo. Attraverso una contestualizzazione (...) delle riflessioni di Nietzsche sul tema del prospettivismo, il presente studio si propone di rilevare la componente pragmatista che si trova alla base di tale critica. In linea con quanto osservato da William James e condividendo molte delle istanze che il suo pragmatismo portò a maturazione, il pensiero prospettivistico di Nietzsche si presenta infatti come strategia per gestire lo svuotamento di senso della nozione di verità a cui conducono i risultati della moderna epistemologia. Esso consiste, in particolare, in una metodologia di orientamento che assume produttivamente su di sé gli spazi lasciati aperti da un sapere non più metafisico e dogmatico e che, pertanto, permette di avviare un nuovo percorso educativo per l’umanità a venire. Porto Alegre: Linus Editora, 2011. p. 69-80. -/- In 1995, the publication of Marleen Rozemond’s paper, Descartes’s Case for Dualism, triggered the revival of the discussion on his argument in favor of the real distinction between body and soul among the Anglo-Saxon scholars. In particular, the discussion then resumed on the necessity of introducing a (...) hidden premise (the so-called attribute premise) in order to regain its probatory character. This debate has reflected on the Cartesian studies in Brazil, and my objective in this text is to bring to the debate two texts still unexplored in relation to this interpretative problem. My hypothesis is that the attempts to justify the thesis that the substance has exactly one principal attribute have not yet succeeded because they underestimated the contribution brought about by the transformation of the notion of nature entailed by the introduction of the concept of principal attribute. Understanding the Cartesian proof of substantial dualism, and more particularly the "attribute premise", would involve, I suggest, the thesis according to which the concept of principal attribute, insofar as it expresses the essence of the substance, is not, and cannot be, according to Descartes, an abstract universal, but rather one of a particular nature. -/- . Un’analisi del film di Ejzenštejn La corazzata Potëmkin – e in particolare della scena della lamentazione funebre del popolo di Odessa attorno al corpo del marinaio Vakulinčuk – offre l’occasione di riflettere intorno a una dialettica fondamentale che si instaura nella teoria e nella pratica filmica del regista russo: la dialettica fra montaggio ritmico e montaggio tonale, fra immagine-taglio (obraz-obrez) e immagine-atmosfera (obraz-sreda). Sreda significa «milieu» in tutti i sensi del termine: ciò che costituisce l’elemento materiale, seppur diafano, del visibile (...) (il medium, quindi); ciò che instaura un campo (Feld) percettivo; ciò che disegna l’ambiance nella quale abitiamo (la nostra Umwelt, o mondo-ambiente), cioè lo spazio emozionale (Stimmung) che ci sollecita dinnanzi a un’immagine. Nel caso particolare analizzato, alla lamentazione funebre dei piangenti attorno al cadavere del marinaio, che viene dettagliata dal montaggio ritmico dell’obraz-obrez, risponde quel che Ejzenštejn chiamava il «lamento delle nebbie» nel porto di Odessa: tramite un montaggio tonale, l’obraz-sreda del paesaggio si fa «risonatore psichico» che consuona e amplifica il lutto degli esseri umani, istituendo con questo una peculiare «somiglianza». L’istituzione di tale somiglianza consente a Ejzenštejn di mettere al contempo in discussione (in sintonia con le riflessioni sviluppate negli anni Venti da teorici formalisti quali Šklovskij, Ėjchenbaum, Kazanskij, Piotrovskij) la presunta specificità del medium filmico, a tutto vantaggio di un’interazione fra differenti paradigmi mediali – pittoricità, musicalità, poeticità – che si illuminano a vicenda, mostrandosi come altrettante articolazioni del ritmo. L’articolo mette in luce due paradossi, il primo dei quali è dato dal fatto che proprio in quelle terre dove si affermò la radicale impostazione anti-umanistica del protestantesimo ebbe a scaturire una straordinaria fioritura dell’umano fino alla consacrazione della libertà come principio della ricerca scientifica e del vivere civile. Il secondo paradosso è dato dalla manifestazione in quelle stesse terre meno di un secolo fa dell’ideologia nazista. La tesi sostenuta è che il principio protestante di fatto affermatosi nella coscienza europea (...) consiste non tanto nella teoria teologica della giustificazione (sola Gratia, sola Fide, sola Scriptura) quanto nella affermazione filosofica e politica della libera coscienza personale, il cui evento decisivo fu la dichiarazione di Lutero alla Dieta di Worms. Ma proprio il carattere abissale della libertà e il destino di interpretazione infinita cui la consegnò Lutero sono anche all’origine di quel disagio della coscienza e dell’esistenza da cui sorse il malessere che portò al totalitarismo.Nel sostenere la tesi enunciata l’articolo si struttura secondo quattro movimenti: 1) argomentazione sul carattere radicalmente anti-umanistico del protestantesimo; 2) argomentazione sui notevoli effetti umanistici storicamente prodotti dalla Riforma protestante; 3) argomentazione sulle possibili connessioni tra il terreno preparato dalla Riforma nella società tedesca e il sorgere in essa dell’ideologia nazionalsocialista; 4) considerazioni finali sulla dialettica della libertà umana. It extends to many branches of philosophy that are relevant to the understanding of the premises and implications of the impacts of climate change on human and nonhuman life on Earth. More specifically, the handbook examines the scientific accounts of climate change as well as its causes. It explores the tools offered by social sciences and humanities to (...) study the societal premises and impacts of climate change as well as delving deeper into the ethical and political issues connected with and resulting from climate change. By doing so, it puts it all in an ecological and historical context. In addition, the book offers solutions to some important philosophical puzzles and problems, and indicates paths of interaction between philosophy and other disciplines. The discussion about climate change and the mitigation/adaptation policies spans many areas and levels – from abstract science and philosophy to current on-the-ground politics. However, climate change is also a great a philosophical puzzle. Indeed, its existential and practical relevance can be thought to largely derive from the philosophical complications it engenders. Climate change is applied philosophy par excellence. Preventing dangerous anthropogenic climate change needs very good philosophy applied to concrete and specific practical issues. Climate change is an area where scholars from very different provenances should cooperate on equal terms, having in view a common, and really important, purpose – contribute to preventing great burdens and even the extinction of humankind and the destruction of hospitable and valuable non-human nature. Ricoeur’s thought bears a number of marks from his reading of the work of Merleau-Ponty. In this article, I argue that this also accounts for the nature of his political thought. I bring Ricoeur’s reviews of Humanisme et terreur (1947) to light in order to show how his confrontation with Merleau-Ponty marked an important turning point in his political thought. Firstly, I show that Merleau-Ponty’s defense of Marxism provoked Ricoeur to reflect upon its intrinsic pathology, and how this marked a (...) significant change in Ricoeur’s political position, namely, from Marxism to personalist socialism.Secondly, I explain how Ricoeur’s reading of Humanisme et terreur gave rise to a preliminary expression of ideas that would later become lasting and essential concepts of his political philosophy. More specifically, the pathology of Marxism would later become embedded in his theory of the political paradox and the concept of the prophet lived on in his reflections on civic responsibility.La pensée de Ricoeur porte un certain nombre de traces de sa lecture de Merleau-Ponty. Dans cet article, je soutiens qu’il en est de même pour sa pensée politique. Je mets en lumière ses recensions d’Humanisme et terreur (1947) pour montrer que sa confrontation avec Merleau-Ponty a marqué un tournant important dans sa pensée politique. En premier lieu, je montre que la défense merleau-pontienne du marxisme a conduit Ricoeur à réfléchir sur sa pathologie intrinsèque et que cela a entraîné un changement significatif dans la position politique même de Ricoeur, quittant le marxisme pour le socialisme personnaliste. En second lieu, j’explique comment la lecture par Ricoeur d’Humanisme et terreur a donné lieu à l’expression préliminaire d’idées qui allaient devenir par la suite durablement les concepts essentiels de sa philosophie politique. Plus précisément, la pathologie du marxisme est devenue plus tard sa théorie du paradoxe politique et le concept du prophète a eu une longue vie dans ses réflexions sur la responsabilité civique.Il pensiero di Ricoeur trae una serie di spunti dalla lettura del lavoro di Merleau-Ponty. In quest’articolo, sostengo che questo valga anche per il suo pensiero politico. Infatti, prendo in analisi la recensione di Ricoeur di Umanesimo e terrore (1947) al fine di mostrare come il suo confronto con Merleau-Ponty segnò un importante punto di svolta nel suo pensiero politico. Innanzitutto, mostro che la difesa del marxismo da parte di Merleau-Ponty portò Ricoeur a riflettere sull’intrinseca patologia dello stesso, e come questo segnò, quindi, un significativo cambiamento del posizionamento politico di Ricoeur stesso, che passò dal marxismo al socialismo personalista. In secondo luogo, spiego come la lettura di Umanesimo e terrore da parte di Ricoeur generò la preliminare formulazione di una serie di idee che più avanti sarebbero diventate concetti essenziali e durevoli della sua filosofia politica. Più nel dettaglio, la patologia del marxismo sarebbe poi diventata parte della sua teoria del paradosso politico e il concetto del profeta avrebbe preso vita dalle sue riflessioni sulla responsabilità civica. The discourse commences with an explication of theories concerning consciousness, progressing to the Turing Test apparatus, and intersecting with Damasio’s research on the human cerebrum, particularly in relation to consciousness, thereby establishing congruence between the Turing Test and Damasio’s (...) notions of consciousness. Subsequently, the narrative traverses the evolutionary chronology of transmuting human cognition into machine sapience, and delves into the fervent endeavors to metamorphose human minds into synthetic counterparts. Additionally, theoretical perspectives from the domains of philosophy, psychology, and neuroscience provide insight into the constraints intrinsic to AI implementations, contentious hypotheses, the perils concealed within artificial networks, and the ethical considerations necessitated by AI frameworks. Furthermore, contemplation of prospective repercussions facilitates the refinement of strategic approaches to safeguard our future Augmented Age Realities within AI, circumventing the prospect of inhabiting an intimidating technopolis where a mere 30% monopolize the intellect and ingenuity of the remaining 70% of human minds. Critical study of preaching and sermons by Kamāl al-Dīn Ḥusayn ibn Ḥasan Khvārazmī on sufism.

Kant scholars have rarely addressed the centuries-old tradition of casuistry and the concept of conscience in Kant’s writings. This book offers a detailed exploration of the period from Pascal’s Provincial Letters to Kant’s critique of probabilism and discusses his proposal of a (new) casuistry as part of an moral education. *** -/- Die Debatte um Kasuistik und Probabilismus zählt zu den wichtigsten Themen der Moraltheologie und Moralphilosophie der frühen Neuzeit. In der enormen Verbreitung der Literatur über die Gewissensfälle (casus conscientiae) (...) und in der großen Resonanz der Lehre von den wahrscheinlichen Meinungen (opiniones probabiles) in der ersten Hälfte des 17. Jahrhunderts findet sich ein wirkungsmächtiges Modell für die Analyse des moralischen Handelns, in welchem Universalität des Gebots und Kontingenz der Handlung, Notwendigkeit der Norm und individuelle Freiheit miteinander versöhnt werden. Dennoch erregt dieses Modell heftige Kritik, die in Pascals berühmtem Angriff in den Briefen in die Provinz (1656–1657) gipfelt. So beginnt für die Kasuistik und den Probabilismus eine lange Krise, welche die Entstehung der modernen Moralphilosophie und den Siegeszug des kantischen Paradigmas ankündigt. Die Krise von Kasuistik und Probabilismus fällt zusammen mit einer einsetzenden rigoristischen Reaktion der christlichen Moraltheologie sowohl katholischer als auch protestantischer Prägung,welche die moralischen und spekulativen Folgen eines Rückgriffs auf Gewissensfälle und wahrscheinliche Meinungen als inakzeptabel ablehnt. Die Ablehnung geht aber weiter und dringt bis in den Kern der philosophischen Reflexion vor: Die rigoristische Reaktion gegen Kasuistik und Probabilismus entzündet sich im moralphilosophischen Denken Kants als Folge seiner umfassenden kritischen Revision der Grundbegriffe der Moralphilosophie sowie insbesondere seiner Neubestimmung des Verhältnisses von Gewissen und praktischem Urteil. Dem Grundsatz des Probabilismus setzt Kant das Kriterium der moralischen Gewißheit („quod dubitas, ne feceris!“) entgegen, das er als „Postulat des Gewissens“ bezeichnet (RGV 6:185.23–186.9).Und die Kasuistik wird als eine „Critic der Handlungen nach Sophistic“ abgestempelt, als eine „Uebung, um nach der Sophistic das Gewissen zu hintergehen oder es zu chicaniren, insofern man es in Irrthum zu setzen denkt“ (V-MS/Vigil 27:620.2–5). Dennoch weist Kant den kasuistischen Fragen eine herausragende Stellung in der Tugendlehre zu und legt der Kasuistik im Rahmen der ethischen Methodenlehre, also im Hinblick auf pädagogische Anwendungen, letztlich eine positive Funktion bei. Vermutlich ist Kants Angriff auf Kasuistik und Probabilismus durch den Einfluss Pascals philosophisch vermittelt. Kants Verhältnis zu Pascal und, allgemeiner, zu dem historischen Hintergrund, welchem dieser angehört, sind gleichwohl noch erstaunlich wenig erforscht: Trotz der wiederholten (stillschweigenden oder sogar ausdrücklichen) Hinweise an wichtigen Stellen in Kants Schriften richtet die Kant-Forschung ihre Aufmerksamkeit nur selten auf die Jahrhunderte währende Tradition der Kasuistik und den Begriff des Gewissens, der in ihrem Rahmen ausgearbeitet wird. Aus dieser langen Geschichte wird in diesem Band insbesondere der Zeitraum „von Pascal bis Kant“ eingehend untersucht, d.h. der noch wenig erkundete Zeitabschnitt von der beißenden Polemik von Pascals Briefe in die Provinz bis zu Kants eigener Kritik des Probabilismus und seinem Entwurf einer (neuen) Kasuistik als Teil der ethischen Methodenlehre.
